Terms & Conditions
These Terms and Conditions („Booking Terms“) set out the basis on GA Holiday d.o.o. („The Sunset Bay Mobile Home Resort “) will provide accommodation and other products and services at its premises („The Sunset Bay Mobile Home Resort“ as defined below) and Guests (as defined below). By making a Booking (as defined below) the Customer agrees to comply with these Conditions.
The Sunset Bay Mobile Home Resort (GA Holiday d.o.o.) provides accommodation and related services according to information available on our web site/advertisement/brochures. Unless otherwise stated, the Total amount includes bed, linen, water, electricity and bathroom towels ( not beach towels ), and air conditioning.
Advance payment is necessary to confirm the booking. The Sunset Bay Mobile Home Resort (GA Holiday d.o.o.) shall confirm the booking once the advance payment is registered on our account. When the advance payment is received, the Client will receive an email Receipt/Voucher from The Sunset Bay Mobile Home Resort (GA Holiday d.o.o.) confirming the payment.
The Receipt/Voucher must be printed out by the Client and presented upon arrival. Unless otherwise stated in the Accommodation Services Agreement, the final payment is to be paid upon arrival at the booked accommodation. In case of subsequent cancellations of a confirmed booking, The Sunset Bay Mobile Home Resort (GA Holiday d.o.o.) shall keep of the advance payment to cover costs related to the booking, as stated under “Client s Right to Changes and Cancellations“.
"Booking" means the reservation of accommodation, products and services by the Customer detailed in the Booking which is accepted by The Sunset Bay Mobile Home Resort.
“Booking Details” means the details of the Booking including the number of guests, the number of rooms required, the duration of the Guests’ stay at The Sunset Bay Mobile Home Resort and any other products and/or services to be included in the Booking.
“Customer” means the person or legal entity who makes the Booking.
“Charges” means the charges payable by the Customer in connection with the Booking
“GA Holiday” means GA Holiday d.o.o. (registered company number 05112591, Gnambova 2, 51000 Rijeka, Hrvatska) that operates The Sunset Bay Mobile Home Resort (located in Uvala Jasenovo 123, Žaborić Brodarica, 22010 Brodarica, Hrvatska).
“Contract” means the contract between the Customer and GA Holiday in relation to the Booking
“Guests” means the Customer and any third parties they invite to The Sunset Bay Mobile Home Resort in connection with the Booking
All Bookings at The Sunset Bay Mobile Home Resort are subject to these Booking Terms.
Customers request or make Bookings via The Sunset Bay Mobile Home Resort website.
When requesting or making Bookings, Customers will be required to provide identification information including, but not limited to, their name, address, contact telephone number and email address.
At the time of booking if paying with credit/debit card Customers will be required to provide their credit/debit card details and the Customer authorises the use of this card for any sums that become owing to The Sunset Bay Mobile Home Resort.
No Booking shall be treated as confirmed until the details and/or payment/deposit described in the Booking Details have been provided.
3. CHARGES & PAYMENT
The Charges will be as displayed on The Sunset Bay Mobile Home Resort Website or as quoted by The Sunset Bay Mobile Home Resort to the Customer upon the Customer’s request for a Booking.
The reservation is confirmed by paying 30% in advance. Payment of the remaining 70% of the total amount must be made 7 days before arrival, as also stated on the issued official offer and proforma invoice.
After paying 30% in advance, the reservation is entered into the system and confirmed. The voucher for arrival at the resort is issued after the full payment of the reservation.
If the reservation is payed by credit/debit card, full amount shall be payed in advance. If for some reason reservation need to be canceled, see cancelation policy rules below (number 4).
The following payment methods are accepted by GA Holiday:
Credit cards (Visa, Mastercard, American Express, Diners Club and DISVOCER)
Debit cards (Maestro)
GA Holiday uses WSPay for online payments. WSPay is a secure system for online payments, real time credit and debit card payments, and other payment methods. WSPay ensures the buyer and the merchant with the secure card data entry and transfer, which is also confirmed by PCI DSS certificate. WSPay uses 256-bit SSL encryption and TLS 1.2 cryptographic protocol as the highest protection standards for data entry and transfer.
Conversion: All payments will be effected in Croatian currency (Kuna). The amount your credit card account will be charged for is obtained through the conversion of the price in Euro into Croatian currency (Kuna) according to the current exchange rate of the Croatian National Bank. When charging your credit card, the same amount is converted into your local currency according to the exchange rate of credit card associations. As a result of this conversion there is a possibility of a slight difference from the original price stated on our web site.
4. CANCELLATION POLICY
Due to the current difficult situation, we have relaxed our cancellation conditions. Should a journey not be possible due to the corona virus, a free cancellation is possible:
Entry ban from your country to Croatia
Renewed lockdown in your country
Enforced, official quarantine on return home (unless a coronavirus test is sufficient for return)
Closure of resorts and autocamps
Otherwise, our normal cancellation conditions apply:
In case of cancellation made at least 30 days from your arrival day, is free;
In case of cancellation with a notice up to 30 days to be calculated from your arrival day, the booking deposit of 30% will be retained.
In the event of cancellation up to 7 days before your date of arrival, 70% of the total agreed price for the stay will be retained.
In the event of cancellation inferior to 6 days before your date of arrival, the reservation is refundable with a voucher for the same season or the next one.
In the event of late arrival or early departure, we will be obliged to charge 100% of the price.
5. CHECK IN & CHECK OUT
Unless otherwise stated, check-in time is from 4;00 pm, check-out time is until 10;00 am.
• If the Client requires check-in or check-out time outside of the above period, or in case of delays, the Client should contact the owner of the accommodation facility or The Sunset Bay Mobile Home Resort and inform them about arrival/departure time or delays. In case of delays on arrival longer than 24 hours - without notification to the owner of the accommodation facility or The Sunset Bay Mobile Home Resort local representative - the Agreement shall be considered as canceled.
• The owner of the accommodation facility or receptionist is responsible to hand the key to the Client on arrival. The Client is responsible to return the key to the owner of the accommodation facility or receptionist or to leave the key on an agreed-upon location on departure.
• The Client is responsible to transfer the accommodation facility back in the same condition as it was on arrival (except for final cleaning). The accommodation facility shall be cleared, trash emptied and removed and dishes cleaned.
6. THE SUNSET BAY RESORT RULES
CONSUMER PROTECTION ACT
In accordance with the Consumer Protection Act (Official Croatian Gazette 79/09), Article 8, Paragraph 1, and the correction of the Law on Amendments to the Consumer Protection Act (Official Croatian Gazette 89/90) Article 5, paragraph 2, written complains which is located at the landlord or e-mail to firstname.lastname@example.org
DESCRIPTION OF STANDARD
The accommodation facilities specified on The Sunset Bay Mobile Home Resort (GA Holiday d.o.o.) web site/advertisement/brochure and described according to the official evaluation conducted by relevant local tourist authorities of Croatia and the owner of the accommodation. The Sunset Bay Mobile Home Resort (GA Holiday d.o.o.) has inspected the accommodation facilities when this was possible.
To be in possession of valid travel documents.
• To verify whether it is necessary for themselves or any other number of their party to obtain an entry visa for the Republic of Croatia.
• To comply with Customs rules and regulations regarding import or export of currency under relevant laws of the Republic of Croatia.
• To agree on house rules in accommodation facilities and accept suggestions of the host made in goodwill.
• To present the confirmation of paid booking ( Voucher received by e-mail ) to the agent or owner of the accommodation facility.
• Not to accommodate other guests in the accommodation facility apart from those stated herein.
• To clean the accommodation before departure ( take out the garbage, wash the dishes and cutlery, empty the fridge )
• By confirming the booking, the Client agrees to report to and reimburse the host for any damages caused to the accommodation facility ( including furniture and kitchenware ) during the stay.
The Sunset Bay Mobile Home Resort shall not be responsible for any destroyed, lost or damaged luggage, not for theft of luggage or valuables from the accommodation unit (we recommend to acquire travel insurance that covers theft). Lost or stolen luggage should be reported to the accommodation facility owner or the nearest local police authority.
The price of accommodation facility booked through The Sunset Bay Mobile Home Resort does not cover insurance of any kind. If the Client wants insurance, it must be bought directly from a private insurance company. The Sunset Bay resort and its owners (GA Holiday d.o.o. , Gnambova 2, Rijeka, Croatia) is not responsible for any damage to property and/or people that occurs during their stay in mobile homes or their surroundings, even if the damage occurs due to the fault of the owner.
Unfortunately, The Sunset Bay Mobile Home Resort is not suitable for disabled Guests.
8. LIMITATION OF LIABILITY
GA Holiday will not be responsible for the loss or damage of any property left in The Sunset Bay Mobile Home Resort other than as required under the Croatian law or any other applicable law.
9. FORCE MAJEURE
GA Holiday d.o.o. accepts no liability and will not pay any compensation where the performance of its obligations is prevented or affected directly or indirectly by or as a result of force majeure or any circumstances beyond its reasonable control including, but not limited to, flood, earthquake, extreme adverse weather conditions, natural disasters, other acts of God, acts of terrorism, fire or failure of electric power, gas, water, or other utility service, plant machinery, computers, vehicles or any collapse of building structures.
10. GOVERNING LAW & JURISDICTION
The Contract and any non-contractual obligations arising in connection with it are governed by Croatian law.
The Croatian courts have exclusive jurisdiction to determine any dispute arising in connection with the Contract, including disputes relating to any non-contractual obligations.
Each party irrevocably waives any objection which it may now or later have to proceedings being brought in the Croatian courts (on the grounds that the Croatian courts are not a convenient forum or otherwise).
11. PERSONAL INFORMATION
The Customer’s rights as a consumer under consumer protection legislation from time to time in force shall not be affected by these Booking Terms.
GA Holiday may transfer its rights and obligations under the Contract to another organisation but will always inform the Customer if this happens and this will not affect the Customer’s rights under the contract.
GA Holiday may, from time to time, change these Booking Terms without notice. However, the version of these Booking Terms in force at the time of the Booking will continue to apply to the Contract. Customers are advised to check The Sunset Bay Mobile Home Resort website for the latest version of these Booking Terms before making a Booking.
No failure by GA Holiday to enforce these Booking Terms shall constitute a waiver of the right to subsequently enforce that provision or any other provision of these Booking Terms. Such failure shall not be deemed to be a waiver of any preceding or subsequent breach and shall not constitute a continuing waiver.
If any provision of these Booking Terms is held by any competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of these Booking Terms and the remainder of the provision in question shall not be affected.
